CONDITIONS OF CARRIAGE

These Conditions of Carriage (“Conditions”) govern the contract between Singapore River Cruise Pte Ltd (the “Company”) and any person who boards, travels on, or otherwise uses the services of the Company (each a “Passenger”) on any vessel owned, chartered, managed or operated by the Company (the “Vessel”) on the Singapore River and Marina Reservoir (the “Cruise”).

By purchasing a ticket, accepting complimentary travel, participating in a group booking or private charter, or boarding the Vessel, the Passenger agrees to be bound by these Conditions.

 

1. Applicability

1.1 These Conditions apply to all Passengers, including but not limited to:

  • Individual ticket holders;
  • Complimentary or promotional passengers;
  • Passengers travelling under group bookings;
  • Private charter guests;
  • Invitees of corporate or event organisers;
  • Any person boarding the Vessel whether or not a physical ticket has been issued.

1.2 Where no individual ticket is issued (including but not limited to private charters, corporate events, group bookings or complimentary travel), the booking party or charterer shall ensure that all guests are informed of and agree to these Conditions prior to boarding.

1.3 In the event of any inconsistency between these Conditions and a separately executed written charter agreement signed by the Company, the written charter agreement shall prevail to the extent of such inconsistency.

2. Tickets, Booking and Payment

2.1 Tickets must be purchased and paid for in full prior to boarding unless otherwise agreed in writing.

2.2 Tickets are valid only for the date, time and service specified.

2.3 Unauthorised resale or commercial use of tickets is prohibited.

2.4 The Company reserves the right to amend fare, route, schedule or Vessel without prior notice.

2.5 The Company reserves the right to refuse boarding to late arrivals, and no refund shall be given in such circumstances.

 

3. Third-Party Ticket Purchases

3.1 The Company shall not be responsible or liable for any ticketing issues arising from tickets purchased through third-party websites, online travel agents, resellers or other intermediaries (“Third-Party Sellers”).

3.2 This includes, but is not limited to:

  • Incorrect or misleading pricing;
  • Failure to issue or deliver a valid ticket;
  • Fraudulent or unauthorised ticket sales;
  • Incorrect cruise details, dates, timings or inclusions;
  • Misinformation published by Third-Party Sellers;
  • Failure of any booking system not controlled by the Company.

3.3 The Company shall not be obliged to honour tickets that are invalid, altered, fraudulently obtained, or not properly issued by authorised sales channels.

3.4 Any dispute relating to ticket purchase, payment or issuance through a Third-Party Seller must be resolved directly with the Third-Party Seller, and the Company shall have no liability in respect thereof.

4. Boarding and Conduct

4.1 The master of the Vessel shall have absolute authority in matters of safety, navigation and discipline.

4.2 The Company reserves the right to refuse boarding or require any Passenger to disembark without refund if, in its sole discretion, the Passenger:

  • Appears intoxicated or unfit to travel;
  • Behaves in a disorderly, unsafe or offensive manner;
  • Poses a risk to safety or security;
  • Fails to comply with crew instructions.

4.3 Children must be supervised at all times by a responsible adult.

5. Weather, Operational Changes and Force Majeure

5.1 The Cruise operates subject to weather, tide conditions, navigational restrictions and regulatory requirements.

5.2 The Company may cancel, delay, shorten, reroute or substitute the Vessel at its sole discretion for safety or operational reasons.

5.3 The Company shall not be liable for cancellations or delays arising from circumstances beyond its reasonable control, including but not limited to adverse weather, mechanical breakdown, government directives, port authority restrictions or force majeure events.

 

6. Passenger Health and Medical Disclaimer

6.1 All Passengers warrant that they are medically and physically fit to undertake the Cruise.

6.2 The Company shall not be liable for any illness, injury, medical condition, allergic reaction, health complication, or death suffered by a Passenger during or after the Cruise, including but not limited to:

  • Heart attack;
  • Asthma attack;
  • Stroke;
  • Seizure;
  • Panic attack;
  • Motion sickness;
  • Pre-existing medical conditions;
  • Any other sudden or underlying medical event.

6.3 The Company does not provide medical personnel onboard and is not a medical facility.

6.4 In the event of a medical emergency onboard, the Company shall use reasonable efforts to contact emergency services where practicable. However:

  • The Vessel may not be able to immediately dock;
  • Treatment may be delayed due to navigational or operational constraints;
  • Emergency response times are outside the Company’s control.

6.5 The Company shall not be held responsible for any delay in medical treatment or for the consequences of such delay.

6.6 Passengers travel at their own risk and are responsible for bringing any required medication.

7. Limitation of Liability

7.1 To the fullest extent permitted by law, the Company shall not be liable for any loss, injury, damage, delay or expense except where directly caused by the Company’s proven negligence.

7.2 The Company shall not be liable for:

  • Indirect or consequential losses;
  • Loss of enjoyment;
  • Loss of personal property;
  • Travel or accommodation costs;
  • Business or reputational loss.

7.3 Personal belongings are carried entirely at the Passenger’s own risk.

7.4 The total aggregate liability of the Company and its employees, in respect of all claims arising from a single incident shall not exceed S$1,000,000.

8. Indemnity

8.1 Each Passenger agrees to indemnify, defend and hold harmless the Company, its directors, officers, employees, crew members and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including legal costs) arising out of or in connection with:

  • The Passenger’s breach of these Conditions;
  • The Passenger’s negligent or wilful acts or omissions;
  • Any health incident, medical emergency or injury suffered by the Passenger not caused by the Company’s negligence;
  • Any claim brought by third parties arising from the Passenger’s conduct.

8.2 For group bookings and private charters, the booking party or charterer shall additionally indemnify the Company against any claims arising from the acts, omissions or health conditions of their guests.

9. Complimentary Travel

Passengers travelling on complimentary or promotional arrangements are subject to these Conditions and shall have no greater rights than fare-paying passengers.

10. Photography and Media

Passengers consent to photography or video recording during the Cruise and the use of such media for marketing or promotional purposes without compensation.

11. Governing Law and Jurisdiction

These Conditions shall be governed by and construed in accordance with the laws of Singapore. Any dispute shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Amendments

The Company reserves the right to amend these Conditions at any time. The latest version shall be made available on the Company’s official website or upon request.
